A power morcellator is a medical device that is used during laparoscopic surgery. The morcellator is a special type of surgical instrument that is used during hysterectomies and uterine fibroid removal procedures to divide and destroy large growths. There are a number of companies that manufacture the power morcellator. Below is a list of just some of the manufacturers:
Recently, the FDA warned against the use of laparoscopic morcellators in the removal of the uterus (hysterectomy) or fibroids (myomectomy) in the majority of women due to the risk of dispersion of unsuspected cancer. The FDA is concerned that the use of laparoscopic morcellators during fibroid surgery may spread cancer and decrease the long term survival of patients.
The FDA further requested that manufacturers warn against the use of power morcellators in removal of uterine tissue containing suspected fibroids in patients who are post-menopausal, candidates for removal of tissue through the vagina, or mini-laparotomy incision candidates. Furthermore, the FDA states that morcellators should not be used in gynecologic surgery in which the tissue is known or suspected to be cancerous.
The FDA estimates that approximately 1 in 350 women who are undergoing hysterectomy or myomectomy for fibroids is found to have an unsuspected uterine sarcoma. The FDA fears that laparoscopic power morcellation in these women creates a risk that the procedure will spread the cancerous tissue within the abdomen and pelvis.
When people are injured by defective medical devices, the appropriate type of claim is a products liability lawsuit that addresses the manufactures failure to warn about certain types of side effects or make appropriate changes to ensure products work as intended.
